Most of what a real estate agent earns is never invoiced at all. Commission on a closed sale is disbursed at settlement by the title or escrow company under a commission disbursement authorization, and in nearly every US state it must be paid to the sponsoring broker rather than to the agent personally. What agents genuinely do invoice is everything around that transaction: referral fees owed between brokerages, transaction coordination billed per file, broker price opinions, marketing costs reimbursed by a seller, and monthly property management fees. Those all need a proper invoice showing the brokerage name, the license number and the property address or file number the charge belongs to. Reference the underlying agreement — the referral agreement, the management agreement, the listing — because the payer is usually another licensed business whose bookkeeper must match your invoice to a contract before releasing funds. Rules on how, and to whom, real estate compensation may lawfully be paid vary by state, so follow your broker and your state commission.

Referral fees are payable within 10 days of the referring party’s receipt of commission at closing and are calculated on the gross commission stated in the referral agreement. Transaction coordination fees are earned on contract acceptance and are payable at closing or on termination of the contract, whichever is earlier. Marketing costs advanced on the seller’s behalf are reimbursed at cost with receipts. Compensation is payable to the brokerage; nothing here alters the parties’ obligations under the applicable state real estate license law.

Real Estate Agent invoicing questions

Can an agent invoice a client directly for sales commission?
Usually not. In most US states compensation arising from a licensed transaction must be paid to the sponsoring broker, who then pays the agent, and commission is normally disbursed through escrow at closing rather than invoiced. Confirm the position with your broker and your state real estate commission before issuing anything that looks like a direct commission bill.
How do I invoice a referral fee to another brokerage?
Reference the signed referral agreement, name the client, the property address and the closing date, and state the agreed percentage alongside the gross commission it was applied to. Address the invoice to the receiving brokerage rather than to the individual agent, include your brokerage tax identification number, and send it after closing when the commission has actually been received.
What should a transaction coordination invoice include?
The property address, the file or MLS number, the contract and closing dates, the flat fee agreed, and who is responsible for paying it — agent, brokerage or client. Coordinators are often paid at closing, so state whether the fee is due on closing or on termination if the deal falls through.
Are real estate services subject to sales tax?
Brokerage commission is generally not subject to sales tax in the US, though a few states tax specific ancillary services and property management can be treated differently from brokerage. Rules also vary considerably outside the US. Check with your state revenue department or an accountant familiar with real estate before adding a tax rate.
